De Tweede Kamer heeft het wetsvoorstel Wet toekomst pensioenen aangenomen. Het wetsvoorstel vloeit voort uit het in 2019 gesloten pensioenakkoord en ziet op pensioenregelingen in het kader van een loopbaan als werknemer of zelfstandige. De opbouw van pensioen gaat voortaan via een premieregeling, waarmee deelnemers een persoonlijk pensioenvermogen vormen. Bestaande pensioenafspraken moeten worden overgezet naar de nieuwe regeling. De fiscale wetgeving wordt aangepast aan het nieuwe stelsel en aan de overgang van oud naar nieuw.
Bij de behandeling van het wetsvoorstel is een groot aantal amendementen ingediend. Voorafgaand aan de stemming over het wetsvoorstel heeft de Kamer over de amendementen gestemd. Aangenomen amendementen betreffen onder meer:
- de tussentijdse waardeoverdracht;
- de verlaging van de startleeftijd naar 18 jaar;
- het afschaffen van de wachttijd;
- het handhaven van het uniform pensioenoverzicht (UPO);
- een permanente geschilleninstantie;
- de beleggingsvrijheid en bijbehorende zorgplichten van de premie-overeenkomst;
- voortzetting van de dekking voor het nabestaandenpensioen;
- een minimale termijn van 15 jaar bij vrijwillige voortzetting.
Als gevolg van door de Kamer ingediende amendementen heeft de regering een aantal aanpassingen van het wetsvoorstel voorgesteld. Daarnaast zijn enkele vergissingen hersteld. Een van de wijzigingen betreft het vervangen van het woord “vermogen” door “kapitaal” op een aantal plaatsen. Voor de aanspraak in de flexibele premieovereenkomst wordt het woord kapitaal gebruikt. Bij de vierde nota van wijziging was deze vervanging al in andere onderdelen van het wetsvoorstel doorgevoerd.
