Laag tarief
Voor de levering of het uitlenen van fysieke boeken, dag- en weekbladen en andere periodieke uitgaven geldt het verlaagde btw-tarief. Met ingang van 1 januari 2020 geldt het verlaagde tarief ook voor digitale uitgaven. Het verlaagde btw-tarief geldt met ingang van 1 januari 2020 ook voor het verlenen van toegang tot nieuwswebsites.
Intracommunautaire transacties
De btw-regels voor grensoverschrijdende of intracommunautaire transacties worden aangepast in verband met de Richtlijn harmonisatie en vereenvoudiging intracommunautair handelsverkeer. Het gaat om:
- de btw-regelgeving over de voorraad die een ondernemer aanhoudt in een andere lidstaat op afroep van een hem bekende afnemer;
- een regeling voor zogenoemde ketentransacties waarmee wordt bepaald welke van de leveringen in die keten als de intracommunautaire levering geldt;
- het bewijs van het intracommunautaire vervoer van goederen naar andere lidstaten; en
- de status van het btw-identificatienummer.
Regeling voorraad op afroep
Een ondernemer kan goederen van de ene lidstaat naar een andere lidstaat verplaatsen om deze in dat land op voorraad te hebben. Deze verplaatsing van goederen leidt tot een fictieve intracommunautaire levering. Deze levering moet de ondernemer melden op zijn aangifte omzetbelasting en op de periodieke Opgaaf intracommunautaire prestaties. In het land van aankomst van de goederen moet de ondernemer een intracommunautaire verwerving aangeven als een met btw belaste prestatie in die lidstaat. De latere levering van de goederen aan een koper leidt tot een aangifteverplichting. Als de ondernemer vóór de fysieke overbrenging van de goederen al weet wie zijn afnemer zal zijn van de goederen die zich daar in voorraad bevinden, vervallen de registratieverplichting en de aangifteverplichting in de lidstaat waar alleen de voorraad wordt aangehouden.
Regeling ketentransacties
Met ketentransacties worden opeenvolgende leveringen tussen ondernemers van dezelfde goederen bedoeld waarbij sprake is van één intracommunautair vervoershandeling of intracommunautaire verzending. Het maakt niet uit hoeveel schakels er in de keten zitten en in hoeveel lidstaten de ondernemers zijn gevestigd of voor de btw zijn geïdentificeerd. Het vervoer of de verzending van de goederen vangt aan bij de eerste ondernemer die levert in de keten waarbij de goederen rechtstreeks gaan naar de laatste afnemer in de keten. De regeling bepaalt aan welke van de leveringen in de keten het intracommunautair vervoer of de verzending wordt toegeschreven. Alleen die levering wordt dan aangemerkt als de intracommunautaire levering. Met deze regeling wordt dubbele belastingheffing of geen belastingheffing voorkomen.
Bewijs intracommunautaire verzending of vervoer op basis van weerlegbaar vermoeden
Eén van de voorwaarden voor de toepassing van het nihiltarief voor intracommunautaire leveringen is de verzending of het vervoer van goederen vanuit een lidstaat naar een andere lidstaat. Het bewijs dat een goed de lidstaat heeft verlaten is relevant voor de toepassing van het nihiltarief. Het aantal benodigde bewijsstukken hiervoor wordt teruggebracht tot twee niet tegenstrijdige bewijsstukken. Zijn er twee niet tegenstrijdige bewijsstukken dan worden de goederen geacht vanuit het grondgebied van de lidstaat van levering te zijn verzonden of vervoerd.
Btw-identificatienummer
Op grond van arresten van het Hof van Justitie van de EU is de aanwezigheid van een juist btw-identificatienummer geen vereiste voor de toepassing van het nihiltarief. Een juist btw-identificatienummer is echter relevant om de goederen– en dienstenstroom en de afdracht van btw te kunnen volgen. Het vermelden van een juist btw-identificatienummer is nu als één van de vereisten voor de toepassing van het nihiltarief opgenomen. Ook het indienen van een juiste periodieke Opgaaf ICP wordt een voorwaarde voor het nihiltarief. Het vermelden van een juist btw-identificatienummer is inherent aan het indienen van een juiste Opgaaf ICP.
