Het Burgerlijk Wetboek geeft de werkgever de mogelijkheid om de arbeidsovereenkomst met een langdurig arbeidsongeschikte werknemer op te zeggen nadat de periode van verplichte loondoorbetaling is verstreken. Aan de mogelijkheid tot opzegging zijn voorwaarden verbonden. Aannemelijk moet zijn dat binnen 26 weken geen herstel zal optreden en dat binnen die periode de bedongen arbeid ook niet in aangepaste vorm kan worden verricht. Er is geen wettelijke verplichting voor de werkgever om een zogenaamd slapend dienstverband op te zeggen. Een belangrijke reden voor werkgevers om geen gebruik te maken van de bevoegdheid tot opzegging van een slapend dienstverband is de verplichting om een transitievergoeding aan de werknemer te betalen.
De vordering van een werknemer met een slapend dienstverband tot ontbinding met toekenning van een transitievergoeding is door de kantonrechter afgewezen. De kantonrechter wees erop dat de werkgever niet verplicht is om de arbeidsovereenkomst na de loondoorbetalingsperiode op te zeggen. Ook is de werknemer met een slapend dienstverband niet gedwongen om in dienst van zijn werkgever te blijven, omdat hij zelf de arbeidsovereenkomst kan opzeggen. De werknemer doet dat in het algemeen niet omdat hij dan geen recht heeft op een transitievergoeding.
De kantonrechter ziet in de per 1 april 2020 in werking tredende Wet Compensatie Transitievergoeding (WCT) geen aanleiding om werkgevers te verplichten om slapende dienstverbanden te beëindigen. De WCT voert een dergelijke verplichting niet in. Ook na de invoering van de WCT houdt de werkgever een belang bij de instandhouding van een slapend dienstverband, omdat de werkgever niet volledig zal worden gecompenseerd voor de betaalde transitievergoeding en deze compensatie zal worden betaald uit het Algemeen werkloosheidsfonds. Dit fonds wordt gefinancierd uit werkgeverspremies.
