Dat de algemene heffingskorting rekening houdt met de draagkracht van een belastingplichtige vindt het hof geen rechtvaardigingsgrond vormen. De staatssecretaris heeft beroep in cassatie ingesteld tegen de uitspraak van het hof.
De algemene heffingskorting kan worden gekwalificeerd als onderdeel van het tarief of als een belastingvoordeel, dat afhankelijk is van de hoogte van het inkomen. In het eerste geval wordt het vrijgestelde salaris indirect belast, doordat het tarief hoger wordt als rekening wordt gehouden met het vrijgestelde salaris. In het tweede geval geldt de hoogte van het inkomen op niet-discriminerende wijze zowel voor personeelsleden van de EU als voor iedere andere belastingplichtige.
De Advocaat-Generaal (A-G) bij de Hoge Raad meent dat verlaging van de algemene heffingskorting door rekening te houden met het vrijgestelde EU-salaris in strijd is met het Protocol betreffende de voorrechten en immuniteiten van de EU. Op grond van de wetsgeschiedenis meent de A-G dat de algemene heffingskorting deel uitmaakt van de berekening van de belastingdruk in de inkomstenbelasting als algemene draagkrachtheffing. Het vrijgestelde Europese inkomen mag daarbij geen rol mag spelen. Daarnaast merkt de A-G op dat de Europeesrechtelijk vrijgestelde inkomsten geen deel uitmaken van het belastbaar inkomen uit werk en woning en dus niet kunnen leiden tot vermindering van de algemene heffingskorting.
De conclusie van de A-G is dat het beroep in cassatie van de staatssecretaris ongegrond dient te worden verklaard. Mocht de Hoge Raad anders oordelen, dan zou de Hoge Raad prejudiciële vragen aan het Hof van Justitie EU moeten stellen.
